Significant Court Action in 2025
As far as general case litigation goes, the SEC vs. Krishnan et al (Nanban Ventures) case came to a close and moved into post litigation stage at the start of 2025. This first post-litigation year was quite active, resulting in 121 court filings. The year 2025 kicked off with the court-issued judgements and settlements from the SEC civil case for each of the 3 partners and the main Nanban Ventures and related legal entities. On February 13, 2025, the legal appeal initiated by the Nanban defendants was dismissed by the Court [Docket 228].
Reasons for lifting the litigation stay
The Court cited several reasons for approving the lift of the litigation stay:
- No statement was ever provided by Nanban parties to doubt defrauded investor claims.
- Due to "the maturity" of the receivership's case and the status of recovery, it was clear that there would not be any dramatic change in asset recovery status. The Court noted that the "state of assets" was not expected to dramatically change.
- The Investors Group's litigation would seek to target assets not in the Receivership or those too costly for the Receiver to pursue.
- The Receiver posed no opposition to the lift in the stay, seeing no negative impact on recovery efforts.
